1.ELIGIBILITY

By becoming a Member, You represent and warrant that You are at least 18 years old. Membership in the Service is void where prohibited. While using and/or viewing this site, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of its terms and conditions that you are at least 18-years old and that you are not prohibited by law from using the Site.

2. TERMINATION

2.1 You may terminate your membership at any time, for any reason by following the instructions on the deactivate Account section in Account Settings. Deleting your account does not trigger reimbursement of, if appropriate, any time remaining on the Member’s subscription.

2.2 TripsWithBenefits.com may terminate your membership for any reason, effective upon sending notice to you at the email address you provide in your application for membership, or such other email address as you may later provide to TripsWithBenefits.com. If TripsWithBenefits.com terminates your membership in the Service because it believes you have breached the Agreement, you will not be entitled to any refund of unused subscription fees or unused credits.

2.3 Under the Consumer Protection (Distance Selling) Regulations 2000, if you are defined as a consumer and are resident within the EU, you may cancel your order for the services within an initial seven day cooling off period. However, in accordance with those regulations, if you choose to use any of the full membership facilities on the site during the seven day cooling off period then you are electing to commence the Service immediately and will no longer have a right to terminate your contract during this period and receive any refund. During this period only, cancellation may be done by giving us written notice or emailing us at support(a)tripswithbenefits.com. Within 30 days of your notice we will provide you with a refund.

2.4 The Company may, in it’s discretion and without liability to you, with or without prior notice and at any time, modify or discontinue, temporarily or permanently, any portion of the Site.

3. NON-COMMERCIAL USE BY MEMBERS

The Website and the Service is for personal use only. Members may not use the Service in connection with any commercial endeavors. Organizations, companies, agencies, and/or businesses may not become members, and should not use the Service or the Website for any purpose. Illegal and/or unauthorized uses of the Website, including collecting usernames and/or email addresses of Members by electronic or other means for the purpose of sending unsolicited email and unauthorized framing of or linking to the Website may be investigated, and appropriate legal action may be taken, including without limitation, civil, criminal, and injunctive redress.

4. PROPRIETARY RIGHTS

Tripswithbenefits.com owns, licenses or otherwise retains all intellectual property rights in the Website and the Service, absolutely. You may not sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from such material without express autorization of TripsWithBenefits.com

5. CONDITIONS FOR USER BEHAVIOUR ON TRIPSWITHBENEFITS.COM

5.1 We ask everybody to report any form of harassing, offensive or violating content, which is not decent or has the intention to degrade other users or the site, or in any other way violates our terms of use. These reports will be handled by our customer service and you will be put in direct contact with one of our employees. Any member which is reported 3 times, will be permanently banned from TWB platform, without any prior warning.

5.2 TripsWithBenefits.com is not an escort service and distances itself from such activities. TripsWithBenefits.com will in no way support escort or prostitution services trying to use TripsWithBenefits.com to promote such services. Profiles suspected of abuse will be investigated, blocked or excluded from TripsWithBenefits.com.

5.3 Profiles, which primary purpose is to sell pictures, videos, webcam shows, telephone- or Skype calls and similar “services”, which resemble actual prostitution, will, without warning, be deleted.

5.4 Users shall not harass other members and/or viewers of the Site.

5.5 It is forbidden to collect or store any information about other members and/or viewers for purposes other than of the permitted use of the Site.

5.6 Any demand from a TripsWithBenefits.com employee MUST be followed. It is important to accommodate warnings or recommendations. Warnings will be issued if TripsWithBenefits.com assesses a behaviour to be a nuisance to other users, the site in general or TripsWithBenefits.com reputation. If warnings are ignored the profile may be blocked or deleted from TripsWithBenefits.com.

5.7 Violations of the above-mentioned terms and conditions are considered as significant default of paid membership. In such cases, any paid membership (“Premium-memberships” etc.) will not be refunded.

5.8 TripsWithBenefits.com reserves the right to go through a profile’s personal messages if the profile has been reported or if it is under suspicion of abusing the system or violating the terms and conditions of TripsWithBenefits. Everything will remain confidential.

6. CONTENT POSTED ON WEBSITE

6.1 Conditions for uploaded pictures on your profile

6.1.1 Uploaded pictures must only be of you an you must hold the copyright.
6.1.2 Uploaded pictures must be sufficient size and quality so that the person is recognizable.
6.1.3 Uploaded pictures may not depict nudity or any other forms of pornography. I.e. breasts and genitals must be covered.
6.1.4 Uploaded pictures may not come across as offensive, hateful, violent, threatening or in any other way depict illegal activities.
6.1.5 Uploaded pictures may not contain logos, links or references to other websites. TripsWithBenefits.com reserves the right to delete every picture on your profile, which violates the above or does not live up to a decent level.

6.2 Condition for the content of your profile

6.2.1 Profile should not contain a username wich is inappropriate or offensive.
6.2.2 Profile should not contain direct or indirect references to prostitution, escort services or another form of human trafficking.
6.2.3 Profile should not link to Facebook or any other social media.
6.2.4 Profile should not contain address, telephone number or any other form of sensitive personal information, which can be used to identify a person.
6.2.5 Profile should not use TripsWithBenefits.com for commercially or containing advertisements TripsWithBenefits.com reserves the right to, at any time and without warning, change or delete profiles wich do not respect the rules above.

6.3 Condition for the chat and video calls

6.3.1 Any video calls should take place in a decent way and respectful.
6.3.2 To ensure the quality of the Service provided, Your communication through the Website may be recorded.

7. SUBSCRIPTIONS AND OTHER PURCHASES

7.1 In order to provide continuous service, TripsWithBenefits.com provides the option for automatic renewal. If the automatic renewal option or checkbox is selected during the payment process, TripsWithBenefits.com will automatically renew all paid subscriptions for the Services on the date such subscriptions expire. After your initial subscription commitment period, and again after any subsequent subscription period, your subscription will automatically continue for an additional equivalent period. By entering into this Agreement, you acknowledge that your account will be subject to the above-described automatic renewals if you had selected the automatic renewal option. If you do not wish your account to renew automatically, or if you want to change or terminated your subscription, please log in and go to “Account Settings” on the Website and follow the directions contained therein.

7.2 TripsWithBenefits offers 3 types of subscriptions: 1 month, 3 months and 6 months. Each subscription will be automatically renewed at the end of the period. You can resign at any moment without losing the benefits of Premium member until the end of the period you paid. The prices of the differents subscriptions are clearly indicated in the account member section in the application.

7.3 We do offer a one-time welcome subscription for new members – 7 days premium membership. This offer is valid only for new members that have never purchased any subscription before. Once the 7 premium days ends, members will pass to one month premium subscription if their auto renewal is enabled.

7.4 Each Premium member subscription includes 15 videocall credits per month (1 credit = 1 minute of videocall). These minutes are credited after each payment or subscription renewal. TripsWithBenefits offers the possibility to purchase extra videocall credits. Premium members can purchase packs of 120 credits (1credit =1 minute of videocall) anytime they need. These purchases are not subject to auto renewal. TripsWithBenefits do not offer a refund for purchasing credits, also the credits are valid as long as the members remains active. Credits can not be used if one member doesn’t have an active subscription. Videocall is a feature that TripsWithBenefits offers only to Premium members with active subscription.
If one member still has credits but stops his subscription, he can use remaining credits only after he will become again premium member. Non premium members cannot buy any credit pack.

7.5 We reserve the right to change the price for provided services at any time. The members or users, who have been already using continuously our services prior to any changes of prices for provided services, will not be subjected to new prices, unless the case of rejoining the Site. The members or users, who have been already using our services prior to any changes of prices for provided services, can be subjected to new prices if they were informed about changes of the prices in advance.

7.6 When you deactivate your TripsWithBenefits.com account or when your account is suspended for violating this Agreement or other policies, you agree that any remaining or unused subscription and credits will be forfeited and no refunds will be issued for any remaining or unused membership subscription and credits. Further, if your deactivated TripsWithBenefits.com account is reinstated at a later date, you agree that any remaining or unused membership subscription and credits you have remaining at the time of your account deactivation will not be reinstated with your account.

7.7 TripsWithBenefits.com reserves the right to offer free membership to any person(s) of its choice at any given time, for any duration, while charging other members, at the same time. TripsWithBenefits.com also reserves the right to cancel the free trial period at any time, for all or any of its members.

7.8 Members can resign their subscription anytime by clicking on the Cancel button present in their subscription details. They will continue to be a Premium member and benefit of all the Premium features until the end of their paid period.

8. PRIVACY

8.1 Personal information you provide to us will only be used by TripsWithBenefits.com, and will never be sold or given to third parties for any purpose without your consent. We are strongly committed to protecting your privacy online and have taken steps to protect information you share with us.

8.2 You must notifyTripsWithBenefits.com immediately of any unauthorized use of your username and password or any other breach of security.

8.3 TripsWithBenefits.com respects your privacy. All personal information you submitted to TripsWithBenefits.com will be kept in the strictest confidence.

8.4 When you place an order online, your personal details and credit card information are encrypted using SSL encryption techology before being sent over the Internet. Although we cannot guarantee encryption or the privacy of your personal details, SSL makes it very difficult for your information to be stolen or intercepted while being transferred.

9. LIMITATION ON LIABILITY

9.1 Except in jurisdictions where such provisions are restricted, in no event will TripsWithBenefits.com be liable to You or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from Your use of the Website or the Service, as well as damages for loss of date, loss of programs, cost of procurement of substitute Services or Service interruptions, even if TripsWithBenefits.com knows or has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, TripsWithBenefits.coms’ liability to You for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by You to TripsWithbenefits.com for the Service during the term of membership.

9.2 TripsWithBenefits.com does not warrant that: the site will meet your requirements .

9.3 TripsWithBenefits does not warrant the site will be uninterrupted, timely, secure, or error-free.

9.4 TripsWithBenefits does not warrant that the quality of any products, services, information or other material purchased or obtained by you through the site will meet your expectations.

If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
